1. Prairie & Pier Is a Marketplace Platform
Prairie & Pier ("we," "us," "our") operates a curated online marketplace connecting buyers with independent Texas-based sellers ("Vendors"). We are not the seller of record for any item listed on the platform. Each Vendor is solely responsible for their listings, product descriptions, accuracy, legality, and fulfillment of orders.
2. Vendor Responsibilities
By listing a product on Prairie & Pier, Vendors agree that:
- All listings are accurate, lawful, and comply with applicable federal, state, and local laws.
- Products are genuinely made, grown, or sourced in Texas.
- They will not list counterfeit goods, prohibited items, hazardous materials, or items that infringe on any third-party intellectual property rights.
- They are solely responsible for collecting and remitting any applicable sales taxes.
- They will fulfill orders in a timely manner and communicate with buyers in good faith.
3. Buyer Acknowledgment
By purchasing on Prairie & Pier, buyers acknowledge that each purchase is a transaction directly with the individual Vendor. Prairie & Pier facilitates payments but is not a party to the sale contract. Product warranties, return policies, and disputes are between buyers and Vendors. Prairie & Pier will assist in good faith to resolve disputes but is not liable for Vendor conduct.
4. Prohibited Items
The following items may not be listed on Prairie & Pier under any circumstances:
- Weapons, firearms, ammunition, or dangerous materials
- Alcohol, tobacco, or controlled substances
- Counterfeit or replica goods
- Items that violate any intellectual property rights
- Any item whose sale is prohibited by law
Prairie & Pier reserves the right to remove any listing and terminate any account at our sole discretion, with or without notice.
5. Limitation of Liability
Prairie & Pier is not liable for any damages arising from transactions between buyers and Vendors, including but not limited to product defects, personal injury, property damage, or financial loss. To the fullest extent permitted by law, our total liability to any party shall not exceed the fees we collected in connection with the specific transaction giving rise to the claim.
6. Dispute Resolution
Any dispute arising from use of Prairie & Pier shall be governed by the laws of the State of Texas. You agree to submit to the exclusive jurisdiction of the courts located in Texas for resolution of any such dispute.
